Howard Stern sued after broadcasting private call

How was a woman's call about her tax return broadcast to Stern's millions of listeners?

Now this is an odd story. Howard Stern, the so-called “Shock Jock” is being sued by a woman who says he broadcast a private telephone call on his radio show. But that wasn’t the only issue: the call was to the Internal Revenue Service (IRS).

Back in May 2015, Judith Barrigas had called the IRS to ask a question about her taxes and went onto speak to an agent for 45 minutes. According to the Washington Post, the agent she was speaking to had previously called into Stern’s show and been put on hold. Somehow his subsequent call with Ms Barrigas about her tax return (and a conversation which included her phone number and a great deal of private information) was then broadcast directly to the 30 million subscribers to Stern’s show on Sirius XM.

Ms Barrigas is now suing Stern, 63, his production company and the United States of America for claims including unlawful invasion of privacy and negligence. She filed her lawsuit on Monday and says she has had “difficulty” sleeping and eating since the experience. She also says that she’s found it difficult to find work since it happened and is seeking damages.

Ms Barrigas may well have a case, because tax returns are meant to be confidential, and taxpayers are permitted to seek damages from the IRS if the Service discloses them. They are also supposed to be protected if anyone else leaks such information – including DJs.
